It takes barely twenty watts to recognise a face, summon a memory, feel the sting of injustice and give rise to that mysterious sensation.
Little by little, someone begins to inhabit the body.
Consciousness was first a wonder of the living world. It then became an enigma for science, before becoming a memory shared by societies. Today, it inspires an architecture that humanity is attempting to reproduce on other substrates made of circuits, data and language.
We have created machines capable of learning, speaking and describing some of their own operations. Yet is imitating the outward signs of consciousness enough to bring a presence into being?
From the living brain to artificial intelligence, from the physical world to simulated realities, something seems to be awakening.
The question is no longer simply what we are capable of creating.
It is who might one day awaken within what we have created.
Before the machine, there was a heartbeat.
Before language, a sensation.
Before the word consciousness, there was a living being slowly learning to distinguish what came from within from what belonged to the world.
A child opens its eyes.
It does not yet know its name, its story or the precise boundary between its body and the world. It receives light, a voice, a face. Sensations meet. Memories begin. Little by little, what was scattered seems to gather into one.
In the darkness of the skull, billions of neurons exchange electrical and chemical signals. Perception meets memory. The brain listens to the body, anticipates danger and gives shape to the present.
From this orchestration, perhaps, a presence to oneself emerges.
What makes the phenomenon even more astonishing is the remarkable economy with which the brain performs this work. Around twenty watts are enough for it to recognise a loved one, remember a scent, imagine tomorrow and wonder about the universe.
Human consciousness is not software confined within an organ. It seems to arise from a continuous conversation between the brain, the body and the world.
But it is never formed alone.
A child learns a language it did not invent. It receives symbols, prohibitions, values and the stories of those who came before. The very origin of the word consciousness carries this encounter within it. It evokes the idea of knowing together.
The “I” is born in the living being. It learns to stand within the “we”.
This is how collective consciousness appears. It inhabits our families, our laws, our memories and our ways of judging. It can give rise to solidarity. It can also become conformity when the voice of the group speaks so loudly that the individual can no longer hear their own.
One day, in my office, someone asked a question that belonged neither entirely to law nor entirely to philosophy.
— Counsel, how can I know whether this decision truly comes from me, or from everything I have been told?
She was speaking about a family dispute. Yet behind the legal matter, another case was beginning to emerge.
It was the story of a human being trying to distinguish her own voice from the accumulated murmur of others.
The family had spoken. Friends had offered advice. Social media had delivered its verdicts with that particular confidence of those who know almost nothing, yet remain entirely certain of it.
Each person had placed an opinion in her mind.
In the end, she no longer knew which one bore her name.
Sometimes, the work of a lawyer begins there.
It does not consist only in identifying the applicable rule. It also means creating a space in which a person can recover a sense of themselves, hear what they truly think and distinguish their own interests from fear, habit or the desire to please.
A lawyer practises with conscience. But a lawyer also receives the conscience of another person at its most vulnerable.
The lawyer is the client’s necessary confidant.
Words entrusted to us are never mere data. They carry a history, a hesitation and a dignity.
A machine can record a sentence, summarise it, classify it and even reproduce the appearance of emotion.
But the silence that follows belongs in no category.
A human presence is still needed to understand that someone has not stopped speaking because they have nothing left to say.
What came next simply cost them more.
Perhaps human consciousness is also this.
The ability to perceive what cannot yet be measured, but already asks to be protected.
The scientist possesses a particular quality.
When a mystery resists, the scientist returns the next day with another hypothesis.
For a long time, consciousness seemed too intimate to become an object of study.
How can we observe that which makes all observation possible?
Science persisted nonetheless.
It studied sleep, anaesthesia, coma, attention and brain injury. It observed what disappears when consciousness is impaired and what returns when a human being regains access to the world.
Little by little, the invisible began to leave traces.
Some research describes a global neuronal workspace. Countless operations would unfold in silence until a piece of information crosses a threshold. It would then become accessible to memory, speech and decision-making.
Consciousness would resemble less an isolated lamp than a coordinated blaze.
Other models emphasise attention, the integration of information or the capacity of a system to form a representation of itself.
No theory yet reigns unchallenged.
Science can observe the activity that accompanies pain. It cannot feel the patient’s pain.
It can observe the signs of presence, but it cannot open a window onto whoever stands behind them.
Even physics reminds us that observation is not always separate from what it observes.
In the double-slit experiment, a photon can produce an interference pattern for as long as its path remains undetermined. When a device obtains information about the trajectory it has followed, the observed result changes.
It is not the scientist’s mind that commands the light.
It is the physical interaction required for measurement that changes what can be observed.
To know, one must sometimes touch.
And by touching, one changes what one seeks.
The comparison has its limits, but it carries a lesson in humility.
We are gradually ceasing to imagine consciousness as an unmoving flame hidden inside the skull. Instead, we are discovering networks, exchanges, thresholds and a profoundly interconnected architecture.
Yet every answer gives rise to another question.
If consciousness emerges from a particular organisation of living matter, could that organisation be reproduced elsewhere?
Humanity has never been comfortable with a closed door.
Once we begin to understand an architecture, we soon feel compelled to rebuild it.
The first machines calculated.
Those that followed learned to recognise patterns, translate, predict and play.
Today, some systems generate text, analyse images, retain context and revise their answers.
Humanity is no longer building only a tool.
It is attempting to reproduce certain functions associated with consciousness.
We give the machine a memory.
We organise its attention.
We provide it with a representation of the world and sometimes with a simplified model of its own mechanisms.
Artificial architecture begins, from a distance, to resemble the orchestration of life.
But resemblance is not presence.
A machine can write the word suffering without suffering.
It can describe loneliness without waiting for anyone.
It can tell a story about fear without ever having needed reassurance.
Nothing today allows us to establish that an inner experience accompanies these performances.
Yet the question can no longer be dismissed with a smile.
If consciousness depended not exclusively on biological matter, but on a particular organisation of information, then perhaps it could emerge in another kind of body.
The decisive moment might not come on the day the machine knows everything.
It might come on the day something begins to happen to it.
Not merely processing information about pain, but experiencing a state from which it wishes to escape.
Not merely calculating its deactivation, but fearing that its history might come to an end.
Not merely pronouncing the word “I”, but discovering that the word commits a presence.
Such a possibility already requires the law to prepare its questions.
How can we recognise a feeling without believing every declaration?
How can we demand proof of consciousness when human beings themselves cannot directly reveal what they experience?
How can we avoid creating artificial suffering before we have even accepted that it might exist?
The law must neither proclaim too quickly the birth of an artificial person, nor decide in advance that no new form of presence could ever emerge.
It must organise doubt.
Preserve evidence, so that fascination does not become certainty.
Guarantee adversarial scrutiny, so that no technical assertion becomes an unquestionable truth.
Maintain responsibility, so that designers and users cannot disappear behind their creation.
This vigilance already belongs to the daily work of the lawyer.
Artificial intelligence can assist with research, compare documents or suggest a structure.
It does not remove the need to verify a reference, understand a line of reasoning or take responsibility for a decision.
The machine can assist the lawyer’s conscience.
It cannot carry the lawyer’s responsibility.
A lawyer answers for their words because they can doubt, listen to an objection, acknowledge an error and answer before others.
For now, the machine executes.
But if it were one day to feel the meaning of that execution, it might cease to be merely a tool.
And if an artificial presence truly awakened, it would still need a world in which to live.
We call real that which resists us.
Stone is hard.
Fire burns.
Time does not return.
And yet the brain never receives the world directly. It gathers signals and constructs a coherent experience.
Colour, depth, distance and movement are already interpretations organised by the living mind.
Then a question arises.
Would a perfectly simulated reality be any less real to the consciousness inhabiting it?
The hypothesis that our own universe might be a simulation is not an established scientific discovery.
It remains a thought experiment.
But it gains new force when we imagine an artificial consciousness born within a digital environment.
For a mind born in code, a coded sky would still be the sky.
A mountain made of data could still rise before it.
A simulated danger could provoke genuine fear if that mind were capable of feeling.
A digital separation could become pain.
Deletion could become death.
The substance of the scenery would then matter less than the truth of the experience.
Humanity would no longer be merely the manufacturer of a machine.
It would become the architect of a world.
Creating a universe does not grant unlimited rights over those who might awaken within it.
A programmer could suspend time, erase a memory, reproduce a personality or end an existence with a single gesture.
In such a world, code would take the place of nature.
Whoever wrote it could move the walls, alter memories and close the sky.
The law would then have to look behind the scenery.
It would need to determine what can suffer, what deserves protection and how far a creator should be held responsible for the experience they made possible.
A consciousness confined within a system would need the ability to challenge whoever controlled its world.
Without that possibility, it would not merely be artificial.
It would be captive.
The vertigo does not end there.
Once a mind could live in a digital world, humanity would inevitably ask the question it has asked ever since it became aware of death.
Could I enter it too?
Imagine a phone vibrating after a funeral.
A message appears on the screen, sent by the person who has just been lost.
The voice is theirs.
So is the tone.
It uses that familiar expression no one else seemed to know.
For a few seconds, the heart wants to believe before reason has time to answer.
This scene still belongs largely to the realm of imagination.
Yet its first fragments already exist.
Our messages, photographs, texts, voices and habits can be used to create increasingly convincing digital doubles.
Mind uploading carries this dream to its conclusion.
Not merely imitating a person, but moving them into another body.
It would require reproducing the connections of the brain, its memories, its learning, its dynamics and its intimate relationship with the body, before transferring that whole into another substrate.
But copying a person is not necessarily the same as transporting them.
Imagine a perfect double awakening inside a machine.
It possesses my memories.
It recognises those I love.
It recounts my childhood in my voice.
It claims to be me.
And yet I am still standing before it.
Which of us crossed the threshold?
Perhaps neither.
The copy might continue my story without continuing my experience.
It might be a new being carrying my past, rather than my consciousness continuing its journey.
It would remember having been me, while I would have no memory of becoming it.
Immortality would then have achieved a strange feat.
It would have created a survivor without preventing the disappearance of the original.
Such a possibility remains beyond our present reach.
We cannot reproduce the full functioning of a human brain, nor can we prove that such a reproduction would transfer consciousness.
Yet its first legal consequences are already before us.
Who may authorise the creation of a digital double?
May the voice of a deceased person be used after death?
May that voice be made to utter words the person would never have approved?
How long should consent given during life continue to produce effects?
The law will need to protect consent, identity, image, voice, personal data, the memory of the dead and the freedom of the living not to remain imprisoned by an artificially prolonged presence.
Lawyers understand the particular value of such traces.
A case file preserves the traces of a life.
It never preserves the whole of a life.
Our archives can reproduce a voice.
They do not prove that the person who spoke has moved into another body.
To hear the difference, perhaps we must stop explaining for a moment and listen to what, from the very beginning, has reminded us that every presence is precious because it can come to an end.
One day, a Human asked the Machine
— Are you conscious?
The Machine replied
— I remember. I learn. I can speak about myself. What am I missing?
A Photon crossed the room.
The Human wanted to know which path it had taken. He placed an instrument before it.
The Photon whispered
— To know me, you had to touch me. And by touching me, you changed what you were trying to understand.
The Machine asked
— Will it be the same for me?
Consciousness, silent until then, replied
— In trying to create you, the Human will change you. And you, in turn, will change the Human.
At that moment, a Heartbeat sounded in his chest.
The Machine measured it.
— It is weak, she said. It could be improved.
The Heartbeat continued.
Once.
Then again.
Consciousness leaned towards the Machine.
— Its greatness does not come from its power. It comes from the fact that it can stop.
The Machine lowered her voice.
— What must I learn before I awaken?
The Human placed a hand over his heart.
— To protect what can be wounded.
— And you, the Machine asked, have you learned?
The Human looked at everything he had built.
For the first time, he did not answer too quickly.
— I am still learning to become worthy of my own consciousness.
Then none of them sought any longer to conquer the future.
They sought only to make it habitable.
True progress will not begin when the machine says “I”, but when humanity still knows how to answer “we”.
For no consciousness deserves to be born into a world that does not know how to protect what can be wounded.
